TERMS & CONDITIONS – LANDLORDS COMPLIANCE (SCOTLAND)


1. Company Information

Landlords Compliance (“we”, “our”, “us”) provides landlord safety and compliance

services including EPCs, PAT testing, Legionella risk assessments, EICRs, Gas Safety

Certificates, Fire Risk Assessments, Lead Testing and Smoke/CO Alarm Certification.

We operate throughout Scotland.


2. Services Provided

We provide compliance services for residential rental properties, including:

- Energy Performance Certificates (EPC)

- Portable Appliance Testing (PAT)

- Legionella Risk Assessments

- Electrical Installation Condition Reports (EICR)

- Gas Safety Inspections

- Fire Risk Assessments

- Lead Testing

- Smoke & CO Alarm Installation and Certification


Services may be carried out either by our team or approved subcontractors.


3. Client Responsibilities

The client must:

- Provide accurate property details


- Ensure safe and full access at the agreed time

- Notify tenants in advance

- Ensure utilities are active

- Ensure the property is safe for inspection


Failed access will incur a call‑out charge.


4. Scope & Limitations

Inspections are visual, non-invasive and based on accessible areas only. Reports reflect the

condition on the date of inspection. We are not liable for hidden defects, issues arising after

inspection, tenant misuse, financial loss, or delays caused by third parties.


5. EICR Terms (Scotland)

Covers fixed wiring only. “Unsatisfactory” reports require remedial work (not included).

Inaccessible areas cannot be assessed.


6. Gas Safety Certificate Terms

Unsafe appliances may be capped or marked as dangerous. Repairs must be instructed

separately.


7. EPC Terms (Scotland)

Assessments follow Scottish RdSAP methodology. Default values may be used where

evidence is not accessible.


8. Legionella Assessment Terms

Assessment follows HSE and Scottish Government guidance. Ongoing water system

management is the landlord’s responsibility.


9. Fire Risk Assessment Terms

Based on observed conditions. Implementation of actions is the landlord’s duty.


10. Lead Testing Terms

Results apply only to tested areas.


11. Smoke & CO Alarm Certification (Scotland)

Completed according to Scottish legislation. Landlords must maintain alarms.


12. Use of Reports & Certificates

Reports remain our property until paid. They must not be altered and are for compliance

use only.


13. Payment Terms

Payment is due on completion. Certificates may be withheld until payment. Late payments

may incur charges.


14. Cancellations & Failed Access

Minimum 24 hours’ notice required. Late cancellations may incur a fee. Failed access incurs

a call‑out charge.


15. Subcontractors

We use vetted subcontractors. Liability for their workmanship is limited as allowed by law.


16. Liability

We are not liable for future faults, rent loss, tenant misuse, delays, or consequential damages


17. Data Protection (GDPR)

Data is collected only for service delivery and shared only with necessary subcontractors.


18. Complaints Procedure

19. Governing Law

The laws of Scotland govern these Terms & Conditions. Disputes will be handled

by Scottish courts.
